Smoke on the water? Nope.

The Coast Guard is saying that it will fine or even arrest people with cannabis onboard boats in coastal waters. Park rangers could do the same in Acadia National Park, which is federal land. FYI. Maine lakes are not overseen by the federal government. Therefore, possession of cannabis on a lake is legal under Maine law. But, please, don't drive a boat while impaired. http://bit.ly/2tB5QPs #marijuana #cannabis #boating #Maine

Big Pot Business Coming to Wiscasset?

A lot of my clients are asking if there is a way to get rec licenses early or to pay to play. No there's not. But it sure doesn't hurt to start talking to your town about what you can bring economically by opening a business. You can pave the way like these people are doing in Wiscasset. Good for them. #makingpotrespectable A shuttered Maine power plant could become a marijuana tourism mecca - Bangor Daily News #marijuana #cannabis #law #business #lawyer #attorney

Fire!

Here’s another set of regulations that your cannabis business needs to pay attention to. The National Fire Protection Association develops the safety codes and standards that most cities and towns use in their own fire codes. If the chapter passes an NFPA vote this month, it will be published on January 16, 2017, and will be in the 2018 edition of the NFPA Fire Code. This means that your city or tow

Your Business and OSHA

Just like any other business, your cannabis business must comply with OSHA regulations if you have employees. OSHA has some record-keeping exceptions for companies with fewer than ten employees, but its safety regulations apply to all businesses – even businesses that the federal government does not recognize as legal. As a business owner, you are responsible for keeping the workplace safe for your employees. OSHA’s goal is to make sure you do that. Fines can be high -- up to

Why Do Some Landlords Not Want to Rent to Cannabis Businesses?

It may not be because they disapprove of the product. Landlords often finance their properties with bank mortgages. A bank mortgage almost always contains a clause requiring the property to be used lawfully. Unfortunately, federal law still makes marijuana completely illegal. Therefore, a bank can call a loan and demand that a landlord immediately pay the entire loan amount if the landlord rents to a cannabis business. If the landlord cannot come up with the money, the bank c

NOTICE: While growing, selling, and using medical marijuana is legal in Maine, it is prohibited under federal law. The federal government may at any time prosecute marijuana possession and sales.

Growing, possessing, and using marijuana for recreational use is legal in Maine with certain restrictions. However, it is still a crime under federal law.

The federal government classifies marijuana as a Class I substance, carrying the highest penalties for possession and sales.

The legal advice that I provide is not intended to assist you with violating or complying with any federal laws.
